FREQUENTLY ASKED QUESTIONS
If only there were a promotions agency to help you decide! 🤣 But seriously: What are your objectives? To support a new product launch? Support retail display? Reward existing consumers? Reach social audiences? Reach new audiences? Your answers will determine which promotion will give you the most wow. It could be a contest, a game of skill, a sweepstakes, or something else.
You bet your hashtag! Entries can be submitted entirely on social media, if you’d like!
Just about anywhere — on social media, on your own brand website, a dedicated microsite, in-store, or somewhere else. But! Each platform has unique considerations, and we carefully guide our clients though the decision.
The short answer? Yes, but keep in mind: There’s always gonna be “that guy” out there who looks for reasons to sue companies that are conducting promotions. Promotion law is highly specialized, so your team needs to be well versed in it. We can also help your team by answering the important questions and pointing out the pesky details that often are overlooked and can come back to haunt you.
Or … you can simply rely on Berlin to manage legal compliance entirely!
Answer: Sí! Oui! Ja! Sim! And yes! We’ve promoted brands to audiences around the world. Our legal counsel has experience working with many countries, and we can translate all of the required international legal language as well as the consumer-facing communications. Keep in mind that legal requirements can vary widely by country or jurisdiction, and approval lead times can vary, so we’ll need ample time to cover all the bases and avoid surprises.
Yes, and we love it! We’ve worked harmoniously with existing agency teams for decades. In fact, we’re such strong collaborators, many agencies first meet us through a shared client and then they specifically look to work with us!
Our collection of personal information during a promotion adheres to the sponsor’s privacy policy and the privacy laws wherever the promotion is running. Typically, information collected in a promotion is used only for the purposes of winner selection, awarding of prizes, and reporting for legal compliance. Entrants may, of course, opt-in to participate in further activity or receive additional information from the sponsor.
Typically, random drawings are conducted by Berlin as an independent judging agency, but contest entries may be judged by a pre-selected panel of qualified judges that can include sponsor representatives.
Lists of winners receiving prizes above a certain value are required by states for release of surety bonds. It is also customary to make a winners’ list available to the public, by request (and with limited actual winner identification) to show that all prizes have been awarded. Don’t worry: Berlin handles all such winners list filings as part of bonding and registration.
It depends. You may need an alternative method of entry, or AMOE. For example, promotional law in the United States for games of chance (e.g., random drawings) prohibits requiring a purchase or other consideration as the only means of entry; an alternate method of entry must be made available. Berlin has several ways of addressing AMOE requirements to fit your overall objectives.
Well, if you’re well versed in promotion law and have the resources to orchestrate a lot of moving pieces, go for it. Consider, though, that a number of clients have come to Berlin Promotions after a failed promotion and/or being hit with legal surprises. Our team has decades of promotional experience; we ask all the what-ifs that you or other agencies might not think about.
For a game of chance executed in the United States, a few states require bonding and/or registration if the total prize pool exceeds a minimum amount. If you extend your promotion beyond the U.S., these laws vary.
As long as you need! Some continuity programs run for weeks or months. A promotion tied to a one-day event, on the other hand, can be active just for that day.
The last thing you want to say at the end of your promotion is, “If only more people had known about it.” The type of support depends on your goals and the type of promotion. You might need media support and a strong social presence. You may need some in-store tactics. We can help you figure this out!
We do, and it’s a job we love! After all, who doesn’t enjoy delivering exciting news to a winner? And you can leave the prize delivery to us, too!
There’s no single answer. It depends on the type of promotion and where you are in the process. Generally, we recommend a lead time of at least eight weeks, but consider that some promotions take months to plan. Berlin moves quickly, but we also move very carefully in order to protect our clients.
Yes.
We provide frequent updates and reports on participation and progress throughout your promotion. We see it as crucial, because it determines any optimizations that we need to make as the promotion progresses.
Yes, as long as the method of entry is disclosed in your rules, you’re fine.
